1. Introduction

1.1 These “General Terms and Conditions of Sale and Shipping Costs” (hereinafter, for simplicity, the “General Terms and Conditions of Sale” or simply the “Conditions”) apply to all purchases of “Roma Tre” branded Merchandising products made through the website store.uniroma3.it (hereinafter the “Site”), by users qualifying as “Consumers” or “Buyers,” pursuant to point 2 below.

Please carefully review these Conditions, the Cookie Policy, and the Privacy Policy (hereinafter jointly the “Data Protection Policies”) before using this website. Please note that the use of this website or the submission of an order through it implies acceptance of these Conditions and the Data Protection Policies; therefore, if you do not agree with all of the above Conditions and Data Protection Policies, you are requested not to use this website.

2. Definitions

2.1 For the purposes of these Conditions, the following terms shall mean:

-Seller: Università degli Studi Roma Tre, with registered office in Rome, Via Ostiense 133, VAT no. 04400441004;

-Site: the website store.uniroma3.it, dedicated to the sale of the University’s official products;

-Roma Tre UniStore: the physical shop located in Rome, Via Ostiense 133, Building A, ground floor;

- Customer/Consumer/Buyer: the individual or legal entity who purchases on the Site, accepting the general terms of sale, and who acts for purposes unrelated to their entrepreneurial, commercial, artisanal, or professional activity, pursuant to Art. 3, paragraph 1, letter a) of Legislative Decree 206/2005 (“Consumer Code”);

- Manager: TECH FOR GOODS società benefit a responsabilità limitata (hereinafter also referred to as the “Contractor”), with registered office in Via Adige 9, 20135 Milan (MI), Tax Code and VAT no. 12994240963, responsible for managing the sale of products on the Site;

-Products: the goods offered for sale on the Site, under these General Terms and Conditions of Sale;

- Contract: the distance contract between the Parties concerning the sale of the Products, under these General Terms and Conditions of Sale;

- Order: the purchase request form for products, completed by the Customer via the Site;

-Price: the consideration for the sale of the products.

3. Subject Matter

3.1 The Site reproduces the catalog of “Roma Tre” branded Products available both for online sale and directly at Roma Tre UniStore.

3.2 Each purchase is governed by the Conditions in force and published on the Site at the time the order is placed. The Contract shall be considered concluded and binding upon the Parties when the Seller sends the order confirmation to the customer’s email address provided during purchase.

3.3 The Seller reserves the right to amend these Conditions at any time, at its sole discretion, without prior notice to Site users. Any changes are effective from the date of publication on the Site, as indicated in the Conditions’ header, and apply solely to sales concluded from that date onwards.

3.4 Before purchasing Products, the Consumer must carefully read these Conditions. By paying for the purchase order created on the Site, the Consumer fully and unreservedly accepts these Conditions.

3.5 The Site is intended for retail sales and is therefore exclusively for Consumers. Non-Consumers, as defined in Art. 3, paragraph 1, letter a) of Legislative Decree 206/2005 (“Consumer Code”), are invited not to place purchase orders. Should one or more sales be made to a non-Consumer, these Conditions will still apply, but by way of exception:

a) the buyer will not be entitled to the right of withdrawal under point 12;

b) the buyer will not be entitled to the warranty on Products under point 10;

c) the buyer will not be entitled to any other protections provided by law for Consumers.

3.6 To purchase from the Site, the Consumer must be at least 18 years old.

3.7 Any communication from the Consumer relating to the purchase of Products—including reports, complaints, requests regarding purchase and/or delivery of Products, exercise of the right of withdrawal, etc.—must be sent to the Seller at the following email address: ________________.

4. Product Characteristics and Availability in Different Geographic Areas

4.1 The Products are described on the Site and sold under these Conditions, excluding any other terms.

4.2 The prices and/or characteristics of the Products available on the Site may change without notice. Before submitting the purchase order, the Consumer must verify the final sale price.

5. Purchase Procedure

5.1 The presentation of Products on the Site, which is not binding on the Seller, represents a mere invitation to Consumers to submit a contractual purchase proposal and not a public offer.

5.2 The Contract between Consumer and Seller is concluded exclusively online. After accessing the Site, the Consumer selects the desired products, consults the product details, verifies the sale price and available sizes (if applicable), and, if wishing to purchase, adds them—one at a time—to the virtual cart.

5.3 The Consumer then proceeds to payment. At this stage, the Consumer must provide personal details (personal data, tax code, email address, and telephone number). If shipping to a location other than Roma Tre UniStore, the Consumer must provide a delivery address. After carefully reading, the Consumer must expressly approve these Conditions, acknowledge the privacy notice, and confirm being at least 18 years old via the checkboxes in the virtual cart. The Consumer must carefully review the entered data before proceeding with payment. The Seller assumes no responsibility for errors made by the Consumer in providing such data that may compromise contract execution or product delivery.

5.4 After payment, the Buyer receives an email Order Confirmation containing details of the purchase, payment, and delivery address. The purchase data are electronically stored by the Seller and the Manager in their systems, in compliance with current regulations.

5.5 The Contract is deemed concluded between the Parties once the Consumer completes payment and receives confirmation.

5.6 If the order cannot be fulfilled due to unavailability (even temporary) of the Product, the Seller shall promptly notify the Consumer in writing and immediately refund any amounts already paid, without penalties, compensation, or additional charges.

6. Product Prices and Shipping Costs

6.1 The Product prices are those indicated on the Site. Prices may change at any time; however, such changes will not affect orders for which the Seller has already sent the Order Confirmation.

6.2 Prices are expressed in euros and include packaging costs, VAT (if applicable), and other indirect taxes (if applicable), but exclude shipping costs to addresses other than Roma Tre UniStore. Shipping costs are borne by the Consumer and calculated in the cart based on the total weight of the purchased Products and the delivery area.

6.3 The Consumer bears any Internet connection costs, including telephone charges, according to their provider’s tariffs.

6.4 For deliveries outside the European Union, Products are accompanied by a proforma invoice of goods only, excluding shipping costs. The Consumer must pay any applicable customs duties and/or taxes in full, according to the laws of the country of delivery. Consumers are encouraged to check with their local authorities for applicable duties or taxes.

6.5 Any additional cost, duty, tax, and/or levy applied by the country of delivery shall be borne entirely by the Consumer.

6.6 The Consumer’s lack of knowledge of the costs, duties, taxes, and/or levies described in 6.4 and 6.5 shall not constitute grounds for Contract termination, nor may such charges be attributed to the Seller.

7. Payments

7.1 Payment for Products purchased through the Site, including shipping costs where applicable, must be made in advance to the Seller by credit card at the time of order.

7.2 All orders are subject to verification. The Seller reserves the right to request identification documents in specific cases; therefore, Customer Care may contact the customer for further payment details before confirming the order. If the required documents are not provided within 72 hours, the order will be canceled and the standard refund procedure applied.

8. Delivery Times and Methods

8.1 The Seller will deliver as soon as possible. Delivery times are indicative and not strictly binding unless explicitly confirmed otherwise in writing by the Seller.

8.2 The Customer may choose the following delivery methods:

a) collection of goods, free of shipping charges, at Roma Tre UniStore within 14 days from receipt of the order confirmation email. In this case, the Consumer undertakes to collect the purchased Products within 30 (thirty) days from the day following the order confirmation email;

b) delivery to the address indicated by the Buyer, with shipping costs charged to the latter.

If the Consumer fails to collect the goods under option (a), and does not provide any justification, the Seller may withdraw from the contract by notifying the Consumer via email. In this case, the Seller retains the products without refunding the Consumer.

8.3 Upon delivery, the Consumer must check that all purchased Products are included and notify the Seller of any defects or discrepancies within three days. Otherwise, the Products are deemed accepted.

8.4 If the package or packaging arrives visibly damaged, the Consumer is advised to refuse delivery or accept it “with reservation.” Responsibility for loss or damage during shipment lies with the carrier.

9. Force Majeure

The Seller shall not be liable for any failure or delay in fulfilling obligations under the Contract if caused by circumstances beyond its reasonable control. In such cases, the Seller is entitled to an extension of time as necessary to perform those obligations.

10. Legal Warranty of Conformity

10.1 Products sold via the Site are covered by the mandatory legal warranty for consumers, against conformity defects existing at delivery. The warranty covers conformity defects arising within two years from delivery, provided they are reported within two months of discovery.

10.2 A product has a conformity defect if it (i) does not match its description or the qualities presented on the Site; (ii) is unfit for normal use; or (iii) lacks qualities typical of products of the same type and reasonably expected. Subject to legal limits, all additional or waivable warranties are excluded, except those that cannot be lawfully excluded for consumers. In case of non-conformity, the Consumer is entitled to restoration of conformity, free of charge.

10.3 The warranty does not apply in case of improper use or washing of the Product, contrary to its intended purpose or instructions provided by the Seller, documentation, tags, or labels.

10.4 The action to enforce defects not fraudulently concealed by the Seller is barred after 26 months from delivery.

10.5 To claim the warranty, the Consumer must notify the Seller by email at store@uniroma3.it , including personal identification data, the non-conforming Product, purchase and payment details, the defect found, and supporting evidence (photos/videos). Upon receipt, the Seller will assess the claim and, if applicable, authorize the return, providing a “Return Reference.” Authorization does not constitute acknowledgment of non-conformity, which will be assessed upon return. The Product must be returned with the “Return Reference” within 20 (twenty) days to: Università degli Studi Roma Tre – c/o Roma Tre UniStore – Via Ostiense 133, 00154 Rome.

10.6 In case of non-conformity, the Consumer is entitled to replacement or termination of the Contract with a refund.

10.7 Refunds are made by bank transfer. The Consumer must provide the Seller with bank details by email to allow repayment.

11. Liability for Damages from Defective Products

11.1 For damages caused by defective Products, Articles 114 et seq. of the Consumer Code apply.

11.2 As distributor via the Site, the Seller is exempt from liability if, within three months of request, it provides the injured Consumer with the identity and address of the producer or supplier.

12. Right of Withdrawal

12.1 Under Articles 52–59 of the Consumer Code, the Consumer has the right to withdraw from the Contract within 14 (fourteen) days from receipt of the Product, without penalties or reason. For multiple Products ordered together but delivered separately, the term runs from delivery of the last Product.

12.2 To exercise the right of withdrawal, the Consumer must send a declaration by email to store@uniroma3.it .

12.3 Withdrawal is valid if the communication is sent before the 14-day period expires.

12.4 If the Product has not yet been shipped, withdrawal is effective upon transmission of the declaration.

12.5 If the Product has already been shipped, the Seller will send the Consumer a “Return Reference,” which must be included in the package with the Products. The Products must be returned to: Università degli Studi Roma Tre – c/o Roma Tre UniStore – Via Ostiense 133, 00154 Rome, within 14 (fourteen) days from communication of withdrawal.

12.6 All risks and return shipping costs are borne by the Consumer.

12.7 For withdrawal to be valid, Products must be returned intact (without wear, abrasion, scratches, deformation, etc.), with all elements and accessories (including labels and tags intact), original manuals, packaging, and warranty certificates, if any. Otherwise, the Consumer has no right to a refund. It is recommended to use protective packaging to preserve integrity during transport.

12.8 The Seller reserves the right to verify that returned Products are intact as required in 12.7.

12.9 If the verification is successful and withdrawal valid, the Seller will refund the Consumer as soon as possible. Refunds exclude shipping costs, duties, or additional taxes incurred.

12.10 Refunds are made via traceable payment. The Consumer must provide bank details by email.

12.11 Withdrawal does not apply to sealed Products unsuitable for return for health or hygiene reasons once opened after delivery.

13. Intellectual Property Rights

13.1 The Seller holds copyright on Site content and industrial property rights on trademarks and distinctive signs relating to the Products.

13.2 The Consumer acknowledges that all trademarks, names, signs, images, photographs, texts, or graphics on the Site or relating to Products remain the exclusive property of the Seller, and no rights are granted through access or purchase.

13.3 Site content may not be reproduced, transferred, modified, or used for any purpose, in whole or in part.

14. Personal Data Protection

14.1 To register, place orders, and conclude Contracts, the Consumer must provide personal data via the Site. Such data are processed by the Manager in accordance with Regulation (EU) 2016/679 (GDPR) and Legislative Decree 96/2003 (Privacy Code), as amended by Legislative Decree 101/2018, solely for purposes relating to browsing the Site and managing orders. 14.2 The Consumer declares and guarantees that the personal data provided during purchase are correct and truthful. The Consumer may update or modify their data and exercise rights under Articles 15 et seq. GDPR at any time. Data will be stored only as long as necessary, in compliance with applicable law.

14.3 Data are stored on external servers of the e-commerce platform provider. The Manager accesses data only for processing purposes and acts as Data Processor under Art. 28 GDPR. Payment data are processed by external operators of authorized digital payment services.

14.4 The Seller and Manager adopt measures to protect personal data against loss, falsification, manipulation, or misuse. The Seller ensures Consumer data in its systems are not accessible to unauthorized third parties. Data may be disclosed to third parties in compliance with national and EU law, particularly carriers for shipping.

 

15. Applicable Law and Disputes

15.1 Each Contract concluded under these Conditions is governed and interpreted according to EU provisions and Italian law, specifically the Consumer Code, with reference to distance contracts.

15.2 Any disputes shall be submitted to the exclusive jurisdiction of the court of the Consumer’s place of residence or domicile.

15.3 The Consumer may use alternative dispute resolution (ADR) mechanisms under Articles 141–141 decies of the Consumer Code.
